Betfair Minimum Bet Guarantee - restricted again

I've been following stories about a minimum bet to win or lay to lose guarantee on this site and others for some time, and I'm sure the creators and other users of this site were relatively happy to see Betfair introduce a minimum bet guarantee of £500 in winnings on GB and Irish Horse racing (https://betting.betfair.com/horse-racin ... 618-6.html)

Well yesterday I received the following e-mail, which was followed by being stake restricted to pennies again:

Betfair would like to remind you of the terms and conditions of the our Minimum Bet Guarantee which are set out onsite. In particular, we would like to draw your attention to the following rules:
Betfair reserves the right to exclude customers from the guarantee who, we believe, are:
executing trades using automated systems or software;
acting in collusion with other accounts, or using multiple accounts to place qualifying bets; or
placing qualifying bets for the purpose of arbitrage (“arbing”). An example of betting behaviour which indicates that a customer may be arbing includes customers consistently or systematically placing qualifying bets when the price is greater than the corresponding back price on the same selection on the Betfair Exchange at the point of bet placement.
Betfair will notify customers if we believe they are breaching these terms of the guarantee. Any further breach of these terms and conditions may result in your account being excluded from the guarantee. Exclusion from the guarantee will not affect any bets already placed prior to the exclusion being applied to your account.
Careful examination of your recent betting history by our traders indicates that you are in breach of one or more of the conditions set out above. You should take note that if you continue to operate your account in contravention of these terms and conditions then we will move to exclude you from the guarantee without further notification. Kind regards.


I can't say I'm not surprised, this is Betfair after all. But I have been surprised to see no negative publicity around this particular development, especially after all the positive press in Racing Post, Guardian and on Betfair's site etc., and the fact that Betfair have claimed to have opened this offer open to all, regardless of previous closures / restrictions.

And before anyone says, I haven't used any software, laying bets off etc., but to be fair I have hammered this offer and made plenty off it.

Thank you for your post.

If you've not breached any of the T&Cs Betfair has listed this is very worrying. There was a similar case on Twitter over the weekend. The person appealed the decision and his account was re-instated. I would recommend you do the same. It's possible that software has marked your account incorrectly?

Basically, if Betfair can't provide evidence of their claims about you it means their contract breaches UK consumer law and would be of interest to the Competition and Market's Authority.

I had the same email from them over the weekend and am exactly like you, I do not know which term they are trying to say I have breached but I know I have not breached the nonsense they listed so evidence would be impossible.

I can still bet to win £500 but I am expecting that to end very soon.

I will find the case on twitter and appeal if this happens and update you on here.

We're meeting with government about MBL again very soon. The Gambling Commission has refused to discuss it.

Just out of interest, I know of BF doing £500 on all racing and Skybet will do £500 on any class 1 and class 2 races, but are there others who are offering that? I was told by someone at BetUK that they were contemplating doing a MBT but it seems to have never come to fruition.

Skybet have limited me to £100 on any race but have not had any issues or any warnings about their £500 on Class 1 & 2 yet....

Ok so my account is now gone. Can only get near to £50 max win on any horse.

I contacted them via CS Chat and got given the following statements:
I am afraid after reviewing your account further we have decided to restrict your betting on the sportsbook part of Betfair. This is a business decision that has been made, we will not be able to reverse this decision. It is something Betfair have looked into strongly and have made this decision with serious consideration.

Betfair does reserve the right to restrict any customer if they wish to do so and we are within our rights. This would be notified ion our terms and conditions. It is non-reversible and cannot be appealed. If Betfair make this decision then I am afraid it is final. This is at the discretion of Betfair and the reason behind this decision will not be disclosed.

I am very sorry but Betfair will not disclose any reason as to why they have made the business decision to restrict you from sportsbook. If they feel the need to restrict you it would be a decision they would not have taken lightly. I am very sorry about this but it is the final decision and cannot be disputed.

My name is Thomas. In our terms and conditions it notifies all customers that we can restrict a customer at anytime at our own discretion if we feel the need to do so.

Sorry but we are within our rights to restrict you. I will see if a manager would be willing to take on the escalation and explain the decision to you aswell but the decision is final and the escalation team will only notify you of the decision.

So I have just spoke with a manager now. We are within our rights to restrict any customer and they have confirmed this with me. They have told me they can send you email and tell you that you are restricted again if you like but the decision is final and the business is happy with the decision. Again I am sorry if you are unhappy with this.
I asked for a reason why, which term I had breached and evidence of what I had breached and was just given the statements above.

I could not find the case on twitter that was mentioned and subsequently do not know how he appealed etc.

Any advice?

So I emailed the CEO and got the following reply within an hour:
Thanks for getting in touch.

I have raised this matter for you over to our Trading department since the decision would come from their end, and unfortunately we would not be able to revert this decision at this time.

All accounts are constantly reviewed and should your account be eligible for a review or appeal, it will be looked into internally from our end.

Unfortunately this decision will stand and is currently not reversible, and I'm afraid we will not be able to contest this for you.

I had requested any information as to why this decision had been taken, however we are not obliged to provide any evidence as to why this decision had been taken.

While I do appreciate where you are coming from, I'm afraid our hands are tied in this case.

Apologies for any inconvenience caused.

So it seems that they are just doing to do what they always do and ban winning accounts, without giving reason or evidence, and get away with it.

Anything you want me to do to follow up or for you to use as a case?

An unacceptable reply from Betfair, I'm afraid.

Yes, I would be keen to take things forward with the hope of outlining a number of issues around MBL. We met with the DCMS about it yesterday - no comment on that at this stage. Please can you email me on info@justiceforpunters.org next week and we can consider the options.

Same thing has happened on Bet UK. I won a few £1000 on some favourites and now my maximum winnings are set to £1..
